DOJ Rulemaking on Hold

The U.S. Department of Justice announced January 21, 2009 that it withdrew from the Office of Management and Budget (OMB) review process its draft final rules for new title II and title III regulations, including updated standards for facility design and construction. All federal Executive Branch agencies will defer publication of new regulations until the rules are reviewed and approved by officials appointed by President Obama.

Withdrawal of the draft final rules does not affect existing ADA regulations. Entities covered by title II and title III must continue to follow the Department's existing ADA regulations, including the ADA Standards for Accessible Design.
